|Speaker:
- Patricia Leonard, Barrister at 7BR Barristers Chambers
Learning Objectives
• Identify the patient-centred legal test for consent established in Montgomery v Lanarkshire Health Board [2015] UKSC 11, including the duty to warn of material risks and of any responsible alternative or variant treatments, and the limits of signed, pre-printed consent forms as evidence that the duty was discharged.
• Examine how the courts have defined "reasonable alternative treatments" and the distinction between an "appropriate" and a merely "possible" option
• Analyse causation in consent claims
• Consider the scope and boundaries of the consent duty in practice
• Apply practical guidance to the investigation and presentation of a consent claim
